Terms of Service

These Terms of Service govern your use of the Tobas Publishing online store and your purchase and use of our digital products. Tobas Publishing is operated by Tobas Strategic Group LLC. By accessing this store or purchasing a product, you agree to these terms.

  1. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to make a purchase. You are responsible for providing accurate billing, contact and payment information.

  1. Digital Products

Tobas Publishing sells downloadable PDF books, guides, workbooks and digital toolkits. Products are delivered electronically through a download link displayed after checkout and/or sent to the email address supplied with the order.

You are responsible for providing a valid email address and using a device and software capable of opening PDF files.

  1. Personal-Use Licence

Your purchase grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the digital product for your personal, non-commercial use.

You may download and print a reasonable number of copies for your own use. You may not reproduce, resell, sublicense, distribute, upload, share, publish, modify for resale or otherwise commercially exploit any product without prior written permission from Tobas Publishing.

Purchasing a product does not transfer ownership of its copyright or other intellectual-property rights.

  1. Orders and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes may be calculated during checkout. Payment must be successfully authorised before digital access is provided.

We reserve the right to decline, cancel or limit an order where fraud, payment misuse, pricing error, unauthorised resale or violation of these terms is reasonably suspected. If we cancel a paid order, the applicable payment will be refunded.

  1. Digital Delivery

Digital products are normally supplied shortly after successful payment. Delivery may occasionally be delayed by payment review, technical interruption or incorrect customer information.

If you do not receive access, contact lshinaba@tobasstrategicgroup.com with your name and order number. Do not forward or publicly post a download link.

  1. Refunds

Digital-product purchases are governed by our Return and Refund Policy. Purchases are generally final once access has been supplied, subject to stated exceptions and any rights that cannot legally be excluded.

  1. Educational Information and Disclaimer

Our books, guides and toolkits are provided for general educational and informational purposes only. They do not constitute medical, psychological, psychiatric, legal, financial or other professional advice and do not establish a professional-client relationship.

Communication examples and templates must be adapted to the purchaser’s circumstances. Results are not guaranteed. If you believe you or another person is in immediate danger, contact local emergency services or an appropriate qualified professional.

  1. Acceptable Use

You may not use this store or its products to violate applicable law; infringe another person’s rights; transmit harmful code; gain unauthorised access to systems; impersonate another person; engage in fraud; harass or threaten others; or distribute purchased materials without permission.

  1. Intellectual Property

All original text, design, graphics, branding, product names and downloadable materials made available by Tobas Publishing are owned by or licensed to Tobas Strategic Group LLC and are protected by applicable intellectual-property laws.

“Tobas Publishing” and associated branding may not be used in a way that suggests endorsement, partnership or affiliation without written permission.

  1. Third-Party Services

The store may use or link to services operated by Shopify, payment providers and other third parties. Their services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services outside our reasonable control.

  1. Disclaimer of Warranties

To the fullest extent permitted by law, the store and digital products are provided on an “as available” basis. We do not warrant that access will always be uninterrupted or error-free, or that a product will produce a particular personal or professional outcome.

Nothing in these terms excludes warranties, rights or remedies that cannot legally be excluded.

  1. Limitation of Liability

To the fullest extent permitted by law, Tobas Publishing and Tobas Strategic Group LLC will not be liable for indirect, incidental, special, consequential or punitive losses arising from the use of the store or digital products.

Where liability cannot be excluded, our aggregate liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

  1. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Tobas Strategic Group LLC and Tobas Publishing from claims, losses or expenses arising from your unlawful use, unauthorised distribution or material breach of these terms.

  1. Changes to Products or Terms

We may update these terms or modify, replace or discontinue products where reasonably necessary. The version posted when you place an order will generally govern that transaction unless a change is required by law.

  1. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in effect.

  1. Governing Law

These terms are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law rules. Mandatory consumer rights applicable in a customer’s jurisdiction remain unaffected.
